The Actiunea Europeana Movement (MAE) intends to sue the Ministry of Justice once again. After losing two cases, the Ministry refuses to register the amendments to the MAE Statute made after the adoption of the law on political parties, which came into force in February 2008. Such an announcement was made by the party’s leadership at a news conference on August 29, Info-Prim Neo reports.
According to MAE leader Anatol Petrencu, the essential change approved at the Second Extraordinary Congress of MAE on June 29 provides for the modification of the party’s name. The Congress added the word ‘party’ to the name Social Political-Movement “Actiunea Europeana”, as required by the law, so that the party is now named Actiunea Europeana Movement Party (PMAE).
Petrencu said that the Ministry of Justice’s refusal forms part of the steps taken against the party, the first of which was the unwillingness to register the party. This time, the Ministry asks for documents needed when reorganizing a legal entity, including documents showing that the property was transferred from MAE to PMAE, and other documents required when registering a new political party. It also demands that the notice is published in two consecutive numbers of the Official Gazette. The Ministry is not satisfied that the amendments to the Statute do not clearly stipulate the legal organizational pattern of this “political party”.
Petrencu said that MAE was not reorganized through transformation, when the legal entity would have stopped existing and its rights and obligations would have been transferred to a new legal entity in succession, but only adjusted the Statute to the new legal requirements. “As there was no transformation, the request to present the document showing that the patrimony was transferred and the notice in the Official Gazette has no legal basis,” the MAE leader said, adding that the other documents asked — the lists of members and delegates – are also needed when registering a new political party. The quoted source said that the reasons invoked by the Ministry of Justice are unacceptable and form part of the methods used to destabilize the work of the party.
In this connection, Nicolae Rosca, MAE vice-president and former member of the group that worked out the Civil Code, said that the Ministry of Justice would have found reasons to reject any of the amendments made by MAE. He described the Ministry’s unwillingness to register the changes to the party’s Statute as ill will and another act by the power against the Opposition parties.
Speaking about the motive that makes the power fight against the Opposition parties, even the smaller ones, Rosca said that MAE is a party that cannot be influenced by the power, so the authorities do not want to enter the elections with a rebel and disloyal party.
MAE intends to sue the Ministry of Justice as it is certain it will win the case again.
