The acting president of the Supreme Court of Justice and the vice president of this institution will be nominated by the Superior Council of Magistracy, as a draft law that was given a first reading provides, IPN reports.
The legislative proposal was formulated in a move to adjust the Law on the Supreme Court of Justice to the constitutional justice administration standards.
Under the bill, if the vice president who fulfills the duties of the president of SCJ in the absence of this is not designated, these tasks will be carried out by the vice precedent nominated by SCM. If the post of president of the Supreme Court of Justice remains vacant, this will be held on an interim bases by a judge nominated by SCM.
Until now, the acting president of the Supreme Court of Justice was named depending on age. In such conditions, the bill authors consider the age, as the only criteria of eligibility for the post of acting president for fulfilling administrative duties in SCJ, is, in essence, prevention of SCM from exerciting its statutory duties.
