A court decided to disband Chisinau Municipal Council in February this year

A court from the capital decided to suspend the activity of the Chisinau Municipal Council (CMC) in February this year but until now this decision was neither executed nor appealed. The Court of Appeal adopted this decision on the request of Chisinau Territorial Office of the Government Staff that reasoned its decision saying that CMC deliberately approved repeated decisions of the same matter that had been afterwards canceled by the court because they were illegal. Details in this context were presented at the last CMC sitting by a councilor from the Faction of the Our Moldova Alliance Oleg Cernei, that expressed his displease that the Juridical Department of the Mayoralty, that defends the interests of the Chisinau Municipal Council, didn’t appeal the decision of the Court of Appeal in superior courts. Moreover, Cernei thinks that without the agreement of the Chisinau Municipal Council, the jurist of the Mayoralty didn’t have the right to recognize in court the reasons presented for dissolving Chisinau Municipal Council, but nevertheless he did so. Cernei requested the deputy head of the territorial office of the Government Staff, Valeriu Didenco, to explain why he didn’t submit to the Parliament, as the legislation in force stipulates, the necessary documents for dissolving Chisinau Municipal Council. Didenco refused to explain saying that he is not obliged to make reports about the actions and intetions of the Government. The councilor Oleg Cernei declared for Info-Prim Neo that there is a real risk that the decision of the Court of Appeal to be executed any moment, and this could be the only case in the Republic of Moldova when a court dissolves a local public administration body. He thinks that the situation is not clarified deliberately, “with the goal to transform Chisinau Municipal Council in a prisoner of certain political interests and structures”. Previously, at CMC sitting, 14 municipal councilors pronounced themselves for dissolving Chisinau Municipal Council, but the proposal submitted by “Ravnopravie” Movement councilor Valeri Climenco didn’t gather the necessary amount of votes. Climenco reasoned his proposal by also saying that Chisinau Municipal Council “adopts several illegal decisions”.
