The Parliament’s legal commission for appointments and immunities decided to reexamine the amendments to the Law on the Constitutional Court (CC) in another meeting. The decision was taken at the suggestion of the Liberal MP Valeriu Munteanu, IPN reports.
Valeriu Munteanu argued that the changes made to the Law on the Constitutional Court must be discussed within public consultations, with experts. Asked by journalists why the Communist and Liberal-Democratic members of the commission accepted his proposal, to his opinion, the lawmaker said that it is probably a game. “Mot probably, at this stage they don’t know how to modify this law. Our supposition is that the bill will be re-voted integrally. This would be the most stupid and crass political and legal decision and they would oblige the head of state to promulgate this law,” stated Valeriu Munteanu.
The Democratic MPs and unaffiliated lawmaker Sergiu Sarbu abstained when the decision to postpone the reexamination of the bill was put to the vote. “We believe that any condition concerning the dismissal of judges will undermine the authority of the Constitutional Court,” Democratic lawmaker Adrian Candu told the press.
“The Constitutional Court should not be limited in its powers. Its competences must not be touched as we thus become involved in the judicial work,” he added.
On May 3, the Communist and Liberal-Democratic MPs passed together a number of bills, including amendments to the Law on the Constitutional Court, by which Parliament is allowed to dismiss the constitutional judges who do not enjoy the lawmakers’ trust. President Nicolae Timofti didn’t promulgate this bill, sending it back to Parliament for reexamination. If the law is adopted by the MPs again, the head of state will have to promulgate it.
