Young man sues his mother for abandonment

The Rascani District Court has recently ruled in favour of a young man who sued his mother because she had abandoned him in childhood. The court found the woman guilty of charge, holding that the plaintiff had been deprived of the right to be raised in a family, and awarded the plaintiff 160,000 lei in respect of non-pecuniary damage. According to the Children’s Rights Centre, Sergiu Druta was 1 when he was abandoned in a hospital. His mother promised to take her child back, but she didn’t keep the promise. Because his mother didn’t sign any document of refusal, the boy never got the chance to be adopted by another family. According to the same source, when he reached 18, the young man was forced out of the boarding school. Throughout the day he worked hard at a building site, and spent the night either at his friends, if he had the chance, or in parks on benches. Two years ago, Sergiu found his mother, hoping that she would accept him into her new family. Nevertheless, the woman rejected him for the second time, saying that she didn’t recognise him as her son and that she didn’t feel sorry for the abandonment. Revolted at his mother’s attitude, Sergiu decided to sue her. A lawyer of the Children’s Rights Centre accepted to represent him in court. He demanded in court that the woman should pay damages for the childhood spent in suffering. Lawyer Octavian Varlan says that Sergiu’s application was admissible by virtue of international and domestic laws. The judge held that Sergu Druta’s mother had deprived him of the right to be raised in a family, and the damages paid are a compensation for the years spent in boarding schools.
