The wife maintained by the socially insured husband will be entitled to maternity benefit if this does not work and does not earn incomes when she goes on maternity leave. This fact can be confirmed by an employment record book and a written own responsibility statement showing that the woman is not insured, IPN reports, quoting a bill approved by the Cabinet.
The bill supplements Article 16, paragraph (5) of the law on allowances for temporary incapacity for work and other social welfare following the Constitutional Court’s decision that the woman who resigned while pregnant and does not have a job when she gives birth cannot be deprived of maternity benefit calculated in accordance with the size of the husband’s salary.
Thus, both the women who didn’t contribute to the public social insurance system and those who contributed partially to it, but lost the capacity for work and are maintained by the husband who is a salary earner are entitled to maternity leave based on the husband’s pay.
A sum of over 182 million lei is needed this year to implement the law.
