The Government has established a methodology to determine the people entitled to free legal assistance from the state, Info-Prim Neo reports. The criterion is the average monthly income of those people. Namely, the free legal assistance will be granted to the people whose monthly income does not exceed the existence minimum per capita, divided to the number of family members. The methodology of computing the existence minimum has not yet been adopted in Moldova, that is why the state proposes a temporary way of computing it. They will take into account the salaries, the incomes from leasing real estate, the social benefits (pensions, indemnities), the incomes of households. They will not take into account the indemnities payed for giving birth to children, for unemployment, the indemnities for young specialists, per diems. The legal assistance will be requested by an application accompanied by documents confirming the incomes for the last 6 months. Adopting the methodology was repeatedly recommended by the Council of Europe and other European institutions and is meant to insure the access to justice to small-income citizens.
