The draft law to amend a number of legal acts to reduce the pressure exerted by state institutions on businesses is designed to make sure that the offenses committed by these are corrected, Minister of Justice Vladimir Cebotari stated in the program “Fabrika” on Publika TV channel, IPN reports.
The minister said the goal is not to criminally punish a business entity. They want a committed wrongdoing to be put right and there is certainty that this company later will not commit the same violations. “The business entity is stimulated to accept blame. Admission of guilt halves the possible punishment. Even if the caused damage is repaired at a later stage, the jail punishment is suspended or is even replaced with fine in a number of cases,” said Vladimir Cebotari. He noted they consider the reeducation instrument will be much more efficient.
The minister said the main objective of the bill is to reduce the pressure exerted on business entities. It will be thus banned seizing servers and documents without which the business cannot continue work. Only copies of these could be made for being used in investigations.
Vladimir Cebotari noted that the amendments do not cover the acts of corruption and money laundering committed by business entities. “We do not want to stimulate organized offenses and recidivism. We rather want to be a god friend of those who obey the law,” he stated.
