The head of the Armenian diaspora in Moldova Venera Gasparean said that her son David Davitean during a year has been held hostage by the law enforcement agencies without being to blame. The woman stated her son is held in the penitentiary’s basement in inhuman conditions and does not have the right to meetings and to receive parcels from the family. Venera Gasparean, who considers that her family became a victim of the ruling regime, calls on the Head of State, as the guarantor of the Constitution, to take this case under control.
In a news conference at IPN, the head of the diaspora said that David Davitean was arrested unjustifiably, in the absence of evidence, and the criminal case against him was started by order, in breach of the Constitution and the rights enshrined in European conventions. During a year, her family has suffered a lot because David Davitean is held in inhuman conditions and in July was sentenced to 16 years in jail.
Venera Gasparean said that not only her family is in such a situation. There are also other families in a similar situation as the law enforcement bodies order arrests and take legal action in the absence of evidence. Neither the prosecutors nor the judges think that they end lives by such acts. While some of the representatives of the law enforcement agencies commit legalities and are not held accountable, others are held in detention without being to blame.
The Armenian diaspora’s head said that living in a multi-ethnic country for over 20 years she has staged numerous activities to strengthen the Moldovan-Armenian relations, but ascertained that the people go abroad and not because they have a good life here. Now her family is the victim of coordinators and executors. Her son was arrested so that his whole family could be blackmailed because her ex-son-in-law Vitalie Proca would have intended to reveal something. The law enforcement agencies wanted to obtain a document and her son was to be released, but the family was lied to and David Davitean was jailed.
Lawyer Alexandru Botnariuc said the case of David Davitean is a political order. The man was arrested in the absence of legal reasons and the trial took place with multiple violations, including of the Constitution. A criminal case was initially started against David Davitean and then this was dropped. The prosecution was illegally resumed by prosecutors who wanted thus to justify their illegalities, assuming powers of the judge.
Lawyer Ludmila Bolocan noted that besides the illegalities committed by the law enforcement agencies, disciplinary punishments are imposed on David Davitean consecutively. He does not have access to medical assistance in a state or private institution for the reason that a group of doctors who examined him in jail concluded that his state of health is satisfactory. But David Davitean has pain in his back and kidneys.
Venera Gasparean called on the President, who is the guarantor of the Constitution, to become involved in this case and take it under his personal control. She also called upon the persons who want to express their support to her family and those who care about the country’s fate to come to the Chisinau Appeals Court starting at 2:40pm on October 10, where a hearing in the case of her son will take place.
