The head of the Armenian diaspora in Moldova Venera Gasparean said her son David Davitean, who was arrested last autumn, was convicted without being to blame for what he was accused of and the criminal case against him was started by order. The woman said both the prosecutors and the judges who bear relation to this case committed a series of illegalities after David Davitean was arrested.
In a news conference at IPN, Venera Gasparean said her son was arrested in the absence of evidence and has been held in a cell in the penitentiary’s basement for a year and two months already. Without having legal reasons, the prosecutors restarted an older criminal case that involved David Davitean, who wasn’t found guilty then. This was done on invented reasons so as to keep him behind bars.
This June, David Davitean was sentenced to 16 years in jail. The family’s lawyer Alexandru Bodnariuc said everything started in November 2012, when David Davitean, looking for his wife, entered by accident an apartment where a number of prosecutors were celebrating in the company of minor prostitutes. As a result of the conflict between those who were present there, a criminal case was started against David Davitean. Ultimately, it was established that David Davitean was innocent and the charges against him were dropped on March 9, 2016.
“What is the saddest is that David in the first instance was convicted in the context of an inexistent case as none of the judges renewed the prosecution against Davitean. This was done by a prosecutor and this is illegal,” stated Alexandru Bodnariuc.
Lawyer Ludmila Bolocan, who also represents the family in court, said David Davitean is held in inhuman conditions. When he needs to come before court, he is escorted by officers of the Special Destination Detachment “Pantera”. This makes him look like an offender who poses a public danger, but this is not true. The image of the so-called injured party in this case, prosecutors Lilian Cociu and Sergiu Rosu, is discredited because these are involved in a number of criminal cases,” stated the lawyer.
“We consider the holding of David Davitean goes against the Constitution and the European Convention on Human Rights,” said Ludmila Bolocan, noting the political games behinds this case have no connection with David Davitean.
The Appeals Court rejected the lawyers’ request to set free David Davitean for the reason that the arrest periods were violated. On December 19, the application will be examined by the Supreme Court of Justice.
