The Supreme Court of Justice restituted the application to review the decision to invalidate the Chisinau early mayoral elections submitted by Andrei Nastase’s lawyers. The decision was taken on July 17 in the absence of the parties, IPN reports.
Contacted by IPN, Andrei Nastase’s lawyer Dumitru Pavel said that by its ruling, the Supreme Court of Justice says that it cannot review a document that wasn’t adopted by it. According to the Court, the decision should be reviewed by the Chisinau Appeals Court.
“We consider this is sheer absurdity, but we will comply. We will go to the Chisinau Appeals Court,” stated Dumitru Pavel.
The legal representatives of Andrei Nastase, whose election as mayor of Chisinau wasn’t validated, submitted an application to review the decision to invalidate the early mayoral elections held in Chisinau municipality to the Supreme Court of Justice on July 11. The application was filed because new circumstances appeared in this electoral case. It was determined that the application to replace the Druta, Gafton and Burduh panel of judges was examined with the involvement of a judge who cannot hold the post of judge because this reached the retirement ceiling of 65.
