Specialized courts will be restored in future, CSM chairman

“I’m in favor of liquidating the specialized courts of law at the current stage, but I think they will be restored in the future because they are necessary,” the chairman of the Supreme Council of Magistrates (CSM) Nicolae Timofti said, quoted by Info-Prim Neo. “I am and was against the liquidation of specialized courts, but, given the state of the legal system in Moldova at present, I agree that they should be removed. They damaged the image of justice by the decisions adopted by them, which were often condemned by the European Court of Human Rights,” said Nicolae Timofti. According to him, the reintroduction of specialized courts is a future subject – these courts will be either incorporated into the legal system as commercial courts or every judge will have to be specialized in the area. “Methods will be identified as there must be specialization. There are serious problems because the legislation regulating the relations in economic, penal, civil and administrative matters is different,” said Nicolae Timofti. Last week, the legislative body passed a bill to eliminate the specialized courts of law in final reading. Thus, the Military Court, the District Economic Court and the Economic Court of Appeals will be liquidated within six months of the publication of the law in the Official Gazette.
