Socialists seek Venice Commission’s appraisal of CCM’s judgment of March 4

The Socialists demand that the Venice Commission should be requested to pronounce on the legitimacy of the March 4, 2016 judgment by the Constitutional Court of Moldova (CCM) concerning the method of electing the head of state. The Socialist parliamentary group made such an approach to Head of Parliament Andrian Candu, IPN reports.

Thus, the Socialists demand that the Venice Commission should pronounce on the admissibility of subjecting constitutional norms to constitutional appraisal and of reviewing them by judgments by the CCM and should say if the Court has the right to invalidate particular constitutional norms.

Furthermore, the Socialists ask that a group of experts should be immediately set up to take part in the assessment of the lawmaking process and of existing and pending legislative acts so as to regulate the organization of the direct presidential elections in Moldova.

On March 4, 2016, the CCM ruled that the provisions of the law to amend the Constitution so that it allowed for the President of Moldova to be elected by Parliament by the votes of 3/5 of MPs were unconstitutional and restored the Election Code provisions concerning the election of the head of state by the people’s vote.
