Sergiu Litvinenco: Candidates for SCM or SCP member can apply until March 27

The law on pre-vetting of candidates for member of the Superior Council of Magistracy and the Superior Council of Prosecutors was published in the Official Gazette and is to be implemented. Minister of Justice Sergiu Litvinenco said the parliamentary groups were already asked to assign members to the assessment commission. Also, Prime Minister Natalia Gavrilița will soon approve the list of the country’s development partners that will delegate representatives to work on the pre-vetting commission, IPN reports.

The minister noted the authorities’ priority is now to implement the law on pre-vetting of candidates for SCM and SCP members. The presence of upright professionals in the self-managing bodies of the judicial system will contribute to an authentic reform in the field.

“The law was already published and we are now in the process of implementing it. We asked the Premier to make an order concerning the list of development partners. Based on this list, we will make approaches to the development partners to choose six members for the assessment commission. The list of six members will be submitted to Parliament for selecting three members. We also asked the parliamentary commissions to assign three representatives, according to the principle of proportionality,” Sergiu Litvinenco stated in the program “Black Box” on TV8 channel.

The minister noted that delegates to the assessment commission will be assigned by the international financial institutions and states that promote the independence of justice and building of the rule of law.

“These are out partners that in time supported the justice sector reform – the U.S. Embassy, the Delegation of the European Union, several embassies that wanted to sign separately from the EU Delegation, the World Bank. March 27 is the deadline for the judges and prosecutors to apply for the post of SCM or SCP member. I call on all the upright persons to file applications,” said Sergiu Litvinenco.

Under the law, the potential members of the SCM and SCP are assessed by a special commission to determine their financial and ethical integrity. The assessment commission will consist of three national members fielded by parliamentary groups and three members provided by the development partners. These are to be confirmed by the votes of 3/5 of the elected MPs. The law will have an effect only until the end of 2022.
