SCM requested to designate new judge at Constitutional Court

Following the death of constitutional judge Eduard Ababei, the president of the Constitutional Court Domnica Manole asked the Superior Council of Magistracy (SCM) to name a new judge, IPN reports.

Eduard Ababei died on January 27. He was named Constitutional Court judge by the SCM in July 2019.

The Constitutional Court has six judges who are appointed for a six-year term. Two judges are named by Parliament, two by the Government and two by the Superior Council of Magistracy. Under the legislation, if the mandate of a judge ends, the president of the Constitutional Court notifies the responsible authorities within three days of the day the post falls vacant, asking this to name a new judge.

The responsible authority designates the judge within 15 days of the day the president of the Constitutional Court sends the notification.
