SCM rejects Domnica Manole’s request to be allowed to return to legal system

The Superior Council of Magistracy (SCM) dismissed as groundless the application to be allowed to return to the system filed by ex-judge Domnica Manole after on July 4 last year she was declared incompatible with the post of judge. The decision was taken in the February 6 meeting of the SCM, IPN reports.

Domnica Manole requested the members of the Council to annul the decision of July 2017 and to be reinstated given that the Constitutional Court ruled that the investigation of judges by the Security and Intelligence Service (SIS) is not constitutional. The judge was dismissed based on a SIS appraisal.

Domnica Manole can challenge the decision in the Supreme Court of Justice within 15 days, but the former judge’s lawyer Viorica Grecu told the press after the meeting that the given decision will not be appealed, but they will request the Supreme Court of Justice to examine the Constitutional Court’s ruling on the investigation of judges.

Domnica Manole was investigated after in April 2016 she passed a judgment whereby the Central Election Commission was obliged to hold the referendum initiated by the Platform “Dignity and Truth”.
