SCM accepts resignation of judge who tried “Gemeni” case

The Superior Council of Magistracy (SCM) on March 19 accepted the resignations tendered by a number of judges. Among these is Sveatoslav Moldovan, judge of the Supreme Court of Justice, who is one of the judges who tried the case “Gemeni” in which Moldova was convicted by the ECHR and obliged to pay €3.6 million damages to the plaintiffs, IPN reports.

According to the SCM, in his resignation Sveatoslav Moldovan invoked health problems. The application was submitted when the judge was already on leave.

Vasile Stihi, of the Orhei Town Court, resigned because he reached the age limit. Aliona Danilov, of the Chisinau City Appeals Court, also stepped down. The resignation of Nicolae Craiu, of the Supreme Court of Justice, was withdrawn at his request.

According to SCM member Dorel Musteață, there are a number of judges who decided to leave the system owing to particular legislative changes concerning social guarantees that will reportedly be adopted soon. Minister of Justice Fadei Nagachevski confirmed that such a bill exists and is being considered.

Today’s meeting was the first meeting of the SCM in its new composition following the appointment of four new members from among law professors.
