Resignation of Mihai Poalelungi is not sufficient, judge

Former member of the Superior Council of Magistracy Tatiana Răducanu, ex-judge of the Supreme Court of Justice, said she was not surprised by the resignation tendered by Mihai Poalelung from the post of Constitutional Court president, but considers that only the resignation is not sufficient, IPN reports.

“The immunity should be lifted and criminal proceedings should be brought over abuse of power,” the former judge noted in a program on TV8 channel. She noted this should be done in relation to all the CC members as separate opinions weren’t stated.

According to her, the judges from the system are afraid to pronounce particular decisions. A number of international institutions said there is fear in the judiciary of Moldova. “We have many international reports from the Council of Europe, the European Commission, European institutions, which say that our judicial system is not independent,” stated Tatiana Răducanu.

Former Superior Council of Magistracy member Teodor Cîrnaț, constitutional law expert, said Mihai Poalelungi’s resignation is somehow late. “I hoped this resignation will be tendered last Saturday, after the CC reviewed its own decisions,” stated the expert.

On June 20, Mihai Poalelungi resigned as president of the Constitutional Court after the authors demanded that the CC judges should all together resign after they during June 7-9 passed judgements on the formation of the parliamentary majority and the Government and later annulled them.
