Lawyer Tudor Leșanu said that the examination of the insolvency case of LLC Repromed is delayed, in breach of the law. According to him, as long as the case is delayed, nothing and no one prevents the misappropriation of funds from LLC Repromed and their transfer to LLC Aidmed or other companies.
In a news conference staged by IPN, the lawyer said that no institution, especially the State Tax Service, can carry out inspections until the court accepts or rejects the application.
“Likewise, the creditors of LLC Repromed, until the application is examined, cannot recover the debts by judicial means. The associates of Repromed LLC, who are in difficult or hostile relations with the Hotineanu family, do not receive their dividends from Repromed LLC. However, the most serious thing, in my opinion, is that the postponement of this case leads to the fact that patients, hoping to benefit from quality services from the famous “Repromed” hospital, actually find out that another company secretly appears – LLC Aimed,’ stated Tudor Leșanu.
The lawyer noted that the law stipulates an examination period of maximum 60 working days. “However, in this case, it will be a period of 238 working days from the beginning of the examination until the next hearing, which was set. Obviously, we ask ourselves: what is the purpose and why is the law applied in a case and is not applied in the case of LLC Repromed,” said the lawyer.
Cristina Mosin, an associate of Repromed LLC, said that patients confirm that, although they benefited from the services of Repromed hospital, the money is collected by Aimed LLC, which no one has heard of. “It is impossible and illegal for two private medical institutions to operate in the same space with the same types of activity. Or, there are a number of technical, medical, especially legal requirements, which do not allow and make it impossible for two institutions to share the same space,” stated Cristina Moșin.
“Through this conference and the explanation of the illegal schemes used both to steal the financial resources of Repromed LLC and to achieve the illegal goals of Aimed LLC, we seek to sensitize not only society, but also the competent bodies so that they do not allow and continue to tolerate the abuses of the Hotineanu clan, which cause not only damage to the company, but also endanger the life and safety of patients. Aimed LLC is a black spot not only for the private medical sector, but also for the entire medical system of the Republic of Moldova,” said Cristina Mosin.
Lawyer Radu Dumneanu, who represents the interests of Professor Vyacheslav Mosin, said that it is unacceptable for two economic agents carrying out the same activity to manage the same room where psychotropic substances are stored. “According to the regulations, this must be a secure room, with thick walls, with secure windows, with a register, and records are kept – each quantity of substance to whom, when and under what conditions is released and why,” said the lawyer, noting it should be clear when Repromed LLC performs surgeries and uses psychotropic substances and why these substances are sold by Aimed LLC.
