A reconciliation agreement is possible in the conflict between the children who are claiming their right on the apartment of their deceased father and their aunt.
According to lawyer Octavian Varlan of the Centre for Children’s Rights (CDC), who represents the interests of the children in the court, the defence asked the court to postpone the sitting to let the parties discuss a reconciliation agreement.
The lawyer says that the mother of the three children, aged 16, 14 and 12, is ready to accept the offer of the defence if the proposed money will be enough for a new studio apartment. Even if the court rules in their favour, the trial will last quite a while and the family which is currently renting an unfitted room cannot wait too long, Octavian Varlan mentioned.
After the divorce of the parents the children were raised by their mother. The man passed away in August 2006. According to the legislation in force, his apartment in Chisinau is to be due to his first degree inheritors - his three children in this case.
Shortly after the funerals, the man’s sister, a professional in the children’s rights protection system, sold the apartment by means of a proxy issued by her brother when he was alive.
CDC sought to annul the sale contract on the ground that the validity of the proxy expired the day when the man died. The court was supposed to pronounce a judgment on the case on November 6.
