Recommendations for improving draft law on ombudspersons

The National Participation Council submitted proposals for improving the bill on ombudspersons. One of the suggestions concerns the territorial jurisdiction of the ombudspersons and the subjects of this law. In a news conference at IPN, the Council’s head Segiu Ostaf said that Article 1 of this law should be amended so that it stipulates that the ombudsperson has jurisdictional authority all over the country and in the situations when the rights of the Moldovans abroad are violated.  

According to Segiu Ostaf, the law must provide guarantees for holding accountable the ombudspersons, while their detention, arrest and search should be possible only with the consent of the competent parliamentary commission, except for flagrant offenses. The people applying for the post of ombudsperson must be known for their activity in the field.

The office of the ombudsperson should include a specialized division that would provide administrative and organizational support and would report to the Council for the Prevention of Torture.

The position of ombudsperson is a central state post equal to the post of European ombudsperson. The role of the ombudspersons is to defend the people’s rights and freedoms in the relations with the public authorities, especially the executive ones.
