The Centru branch of the Chisinau City Court annulled the police report ascertaining that Andrei Năstase, the PPPDA candidate for mayor general of Chisinau municipality , campaigned during the new local elections of May 20 and June 3. The decision was pronounced on October 17.
Contacted by IPN, Dumitru Pavel, lawyer for Andrei Năstase, reminded that the Party of Socialists (PSRM), when it went to court and complained that Andrei Năstase campaigned on the election day, filed a complaint to the police as well. The police investigated the accusations made against Andrei Năstase and drew up a report ascertaining the presence of electoral agitation on the election day.
Andrei Năstase challenged that report and the court today annulled it, indirectly admitting that there was no electoral agitation. “If this decision remains in force, I think it will be a reason for reviewing the case of invalidation of the election of the mayor and of the elections in general and for passing a new judgement by which to validate the elections,” stated Dumitru Pavel.
According to him, the court decision by which the local mayoral elections were invalidated was taken based on the complaint filed by the PSRM to the police. In Moldova, the electoral agitation violation that was allegedly committed by Andrei Năstase is punished with a fine only and the court’s decision to invalidate the elections is thus illegal.
