The Supreme Court of Justice (SCJ) annulled 21 decisions on the failing of testing by candidates for member of the Superior Council of Magistracy (SCM) and the Superior Council of Prosecutors (SCP) taken by the Pre-Vetting Commission. The head of the Parliament’s legal commission for appointments and immunities Olesea Stamate said that this is a new attempt by the corrupt groupings from the system to block the extraordinary assessment of judges and prosecutors, IPN reports.
“The recent decisions by the SCJ by which they try to annul all the decisions of the Pre-Vetting Commission show that some of the judges do not want vetting. I consider the decisions were intentionally adopted at a particular moment, namely immediately after Parliament passed the vetting law and after the last plenary sitting of Parliament was held as the legislative body went on parliamentary vacation,” said MP Olesea Stamate.
According to her, the most important moment is that the decisions were taken when the judges who remained at the SCJ received notification from the Vetting Commission – from that moment they have 20 days to decide whether they go on to vetting or resign. Before tendering their resignations, they decided to disseminate a last message, to make a last attempt to sabotage the reform.
“We examined a part of the decisions. In many of them, we identified clear abuse, evident violation of the legal norms. The intention to sabotage is even clearer when we see that all the decisions were annulled. So, they didn’t examine thoroughly to see if some of them deserve to be sent back for reexamination or not. They followed the principle “after us, the end of the world can come,” stated Olese Stamate.
The Pre-Vetting Commission issued a press statement saying that it took note of the SCJ’s decisions. “When these are officially received, the Commission will meticulously analyze the Court’s arguments and will decide the subsequent actions,” runs the statement.
On August 1, the SCJ annulled the 21 decisions showing that the candidates member of the SCM and SCJ failed the testing. The 21 candidates are: Angela Popil, Vladislav Holban, Alexei Panis, Anatolie Gîrbu, Veronica Cupcea, Alexandru Rotari, Stanislav Sorbalo, Valentin Caisin, Ion Chirtoacă, Vitalie Codreanu, Vitalie Stratan, Angela Bostan, Aureliu Postică, Victor Sandu, Nicolae Șova, Aliona Miron, Cristina Gladcov, Tatiana Chiriac, Ecaterina Buzu, Mihail Bușuleac, and Sergiu Osoianu. The Court ordered a reexamination of these by the Pre-vetting Commission.
