Public servants of retirement age can be dismissed, Constitutional Court

Any public servant can be discharged from post when they reach retirement. The constitutionality of these provisions contained in the Law on the Public Post and the Status of Public Servant was confirmed by the Constitutional Court on March 22, Info-Prim Neo reports. The Constitutional Court was requested to examine the issue by the Supreme Court of Justice after analyzing the application filed by Petru Rotundu, who was dismissed from a public post in 2010, when he reached retirement age. A former senior specialist of the Education Ministry’s Secretariat Division, Petru Rotundu argued that the given provisions discriminate against the public servants who reach retirement, but want to continue work. The Constitutional Court decided that the given article is constitutional. The decision is definitive. After the Constitutional Court’s hearing, Petru Rotundu said he is considering suing Moldova at the European Court of Human Rights as the given article represents an instrument for getting rid of inconvenient public servants who do their job well.
