Public officials found guilty of abuse of authority will be punished according to the Code of Administrative Offences

The abuse of power of the public officials and their involvement in entrepreneurial activities will be punished according to the Code of Administrative Offences. The Government approved a draft law containing amendments to the Code of Administrative Offences, the Penal Code and the Code of Penal Procedure. Thus, a public official risks a penalty fine consisting of 50 to 150 conventional units (one conventional unit equals to 20 lei), and deprivation of the right to hold certain positions or to be banned from working for a period of 1 to 3 years, if he/she is found guilty of using the job position for encroaching upon the interests of natural or legal entities protected by law. The same penalties are valid for trespassing the limits of the rights attributed by the law. Also, the public official will be penalized with a fine consisting of 50 to 100 conventional units, and deprivation of the right to hold certain job posts or to be banned from working for a period of 1 to 3 years, if he or she establishes businesses and manages them directly or indirectly through other persons.
