The prosecutor of Chisinau municipality Ion Diacov said the bill to reform the prosecution service that was adopted by Parliament in the first reading will allow to further commit abuses and will not improve the situation in the field. In a news conference at IPN, Ion Diacov said the current Law on the Prosecution Service must be amended not radically, but slightly.
The prosecutor noted that he informed the country’s administration about the consequences of adopting the given bill in the final reading. The bill was drafted to meet somebody’s interests, while the creation of a prosecutor’s office for organized crime in Moldova, which is a vulnerable state, will become a political cudgel against those who are inconvenient.
Ion Diacov said that earlier former Prosecutor General Valeriu Zubco and former Minister of Justice Alexandru Tanase proposed that the prosecutors should also be given the status of judge. This will make the prosecutors less vulnerable to influences from outside, but this initiative scares some of the politicians.
According to the prosecutor of Chisinau municipality, the prosecutor general over the last five years has practically usurped the state power. When this is named by Parliament, he must submit a list of the members of the Board of the Prosecutor General’s Office and then work within the Board. But the Board hasn’t been formed during five years and the prosecutor general always took decisions by himself. Now the bill that was passed in the first reading liquidates this Board and this is a big mistake.
Ion Diacov said liquidating of the National Anticorruption Center would also be a serious mistake as this body should deal with corruption cases involving prosecutors, judges, ministers, MPs and other persons holding responsible posts. This way the Center will work in a serious manner and will no longer present cases of bribery involving teachers and doctors as this would be the duty of the Prosecutor’s Office.
The prosecutor also stated that Moldova is seriously stricken by corruption and does not have a future if a real prosecution service reform is not done. He called on the MPs not to vote the current bill in the final reading under the influence of the protests, but to analyze thoroughly the situation and to take a correct decision.
