Prosecutor General could be appointed by President

The Prosecutor General of the Republic of Moldova will be nominated by the Prosecutors' Chamber, a body of the Supreme Magistracy Council, and appointed by presidential decree, as provided in the draft version of the new Moldovan Constitution. The chapter regulating prosecutorial bodies and courts of the new fundamental law was discussed at today's meeting of the Commission for constitutional reform, Info-Prim Neo reports. The initial proposal was that the Prosecutor General would be nominated by the Prosecutors' Chamber and appointed by Parliament. But Justice Minister Alexandru Tanase objected. “There were cases where the Magistracy Council delegated somebody, but the deputies didn't vote for that person, because you cannot make a deputy vote”, said Tanase, suggesting that the appointment of the Prosecutor General should be the prerogative of the President. The Commission endorsed the proposal. The new version of the Constitution also provides that the prosecutors, including the Prosecutor General, will be appointed for 5-year terms. Justice will be administrated by the Supreme Court, the Court of Cassation, appellate courts and district courts, according to the draft.
