The political dialogue between Chisinau and Tiraspol when there is no respect for the basic human rights and fundamental freedoms is useless because the people in Transnistria do not have confidence in a democratic system as long as their rights are not guaranteed, executive director of the Association “Promo-LEX” Ion Manole said in a news conference at IPN. According to him, a mechanism should be identified to ensure the people from Transnistria have access to a credible and efficient institution that will protect their rights.
The members of “Promo-LEX” consider the problem of transition justice should be treated as a priority in the Transnistrian conflict settlement talks. The tolerance of the use of pseudo-legislation on Moldova’s territory is inadmissible. “It’s not normal to have a black hole for the human rights, where there are no mechanisms and no possibilities of defending the rights when these are violated,” stated Ion Manole.
He also said that “Promo-LEX”, together with other representatives of civil society from both sides of the Nistru River, will make effort to identify a mechanism by which to create a credible and efficient institution that will defend the human rights in the Transnistrian region.
The statements were made after presenting the ECHR’s decision in the case of Mozer versus Moldova and Russia. In this case, the Court found Russia guilty of violating the rights to freedom and safety of Moldovan citizen of German origin Boris Mozer, who was arrested by the Transnistrian militia and held in inhuman conditions.
The members of “Promo-LEX” said that this decision should make the authorities and the foreign partners to reconsider particular approaches that were to the detriment of the Transnistrians. The conclusions formulated in the ECHR’s decision are sufficient for Moldova to take steps and ensure the observance of the human rights in the region.
“Promo-LEX” also considers that Russia and Moldova should take prompt action to guarantee a legal framework compatible with the European Convention for the Transnistrian region. “The conflict areas are not outside the international normative framework and the people who live there have the same rights as any other person who is on the European territory,” stated Ion Manole.
According to him, this decision shows that Russia is responsible for the violation of the human rights in the Transnistrian region namely because it ignores the appeals, approaches and complaints of the people from the left side of the Nistru and continues to finance the Transnistrian regime without imposing particular conditions.
