The persons suspected of driving under the influence will be subject to one test – either the breath test or the medical examination by giving a blood sample. Under the amendments to the Criminal Code and the Code of Administrative Offenses, the results of the breath test will be used as evidence for setting the fine, IPN reports.

According to the National Patrolling Inspectorate, the state of minimum degree inebriation is when the concentration of alcohol in blood is 0.3 to 1 g/l or the concentration of alcohol vapors in the exhaled air is 0.15 to 0.5 mg/l. The state of advanced inebriation is when the concentration of alcohol in blood is 1 g/l and over or the concentration of alcohol vapors in the exhaled air is 0.5 mg/l and more.

If the person does not agree with the results of the breath test, they can ask for a medical test. The amendments to the Code of Administrative Offences  provide that the fine for minimum degree inebriation is 3,000 lei and the person is deprived of the driver’s license for two to three years. In case of advanced inebriation, there is taken legal action.
