The persons with mental disabilities declared incompetent by the court of law have the right to be included in the category of beneficiaries of the social service “Protected Home”. Such a judgment was passed by the Constitutional Court, IPN reports, quoting a press release.
Lawyer Doina Ioana Straisteanu requested the Constitutional Court to pronounce on the Government decision concerning the rights of persons with mental disabilities declared incompetent by the court of law.
The Court held that even if the objective of the service is to integrate the persons with mental disabilities into society, the persons declared incompetent by court decision were deprived of the possibility of benefitting from this service. Thus, the Court declared the given provisions of the Government decision No. 711 of August 9, 2010 unconstitutional.
