Persons must be informed that they were checked out when investigation is over

The period of investigating a person is limited by the time needed for achieving the objectives. If the secrecy clause was set for a period, the person who was checked out must be mandatorily informed about this when this period expires, Sergiu Bozianu, deputy division head at the National Center for Personal Data Protection, said in a press club meeting, IPN reports.

If the person is not informed about the fact that their personal data have been checked, the Law on Personal Data Protection is violated. “The law provides that in five years of the restricting of access to information about a person, the authority that did this must inform the subject about the taken actions: either the person was put on the wanted list or was followed. There should also be an authority that would check how the secrecy of this information is kept and if the subjects are later notified,” stated Sergiu Bozianu.

The investigation of an offense or contravention falls under the Law on Personal Data Protection. The given information is verified by the National Center for Personal Data Protection.

Sergiu Bozianu also said that there should be a limit for verifying the information. The prosecution body can restrict access to personal information, not yet for an unlimited period of time. When the investigation is completed, the persons must know that they were checked out.
