Parliament to vote in SCM members from among non-judges this week

The legislative body in this week’s sitting will confirm the new members of the Superior Council of Magistracy (SCM) from among non-judges, who were assessed by the pre-vetting commission. This way, when the Parliament decision on the appointment of members from among non-judges is adopted, the SCM will become functional. Even if its composition will not be complete, the Council will start to unblock particular processes in justice and will first and foremost announce the contest to fill the vacancies available at the Supreme Court of Justice, Parliament Speaker Igor Grosu told a news conference.

“I repeatedly call on the correct, honest judges who form part of the guild of judges to be courageous, come to the forefront and finally organize that General Assembly, take part in those contests that will be announced by the new composition of the Superior Council of Magistracy,” said the Speaker.

Igor Grosu also said that the package of bills to modify the method of functioning of the Supreme Court of Justice will be given a second reading and this Court will be now a court of cassation and will pronounce only on cases of major importance for society. Also, the composition of the Court will be modified and this will consist of 11 judges and of nine non-judges. Respectively, the number of members of the Supreme Court of Justice will decrease from 33 to 20.

The Speaker noted that the second draft law on the Supreme Court of Justice refers to the extraordinary assessment of judges of the Supreme Court of Justice and the candidates who will aspire to occupy a post at this high-instance court. An assessment commission will be set up and this will start work in May.

The amendments that define the duties of the Anticorruption Prosecutor’s Office will be given a first reading. The legal framework for creating the Anticorruption Court is also being prepared.

Another package of bills defines the duties of the Security and Intelligence Service, the internal governance method and the duties of the director of this Service, the rights and obligations of the persons who cooperate with the institution, the judicial mandate for fulfilling duties, etc.
