The adoption, amendment or abrogation of organic laws and electoral legislation will be possible during states of emergency, siege and war. Parliament voted in favor of excluding the given restrictions from the law on the regime of the state of emergency, siege or war at the suggestion of the Government, IPN reports.
Minister of Justice Fadei Nagachevski said that additional powers were given to the institutions responsible for the management of the state of emergency, siege or war so that other emergency measures could be taken, depending on the situation.
Only the amendment of the Constitution will not be possible during states of emergency.
PAS MP Lilian Carp asked to specify the emergency measures that can be taken additionally. Vasile Bolea, chairman of the legal commission for appointments and immunities, could not state these.
The law will take effects when it is published in the Official Gazette.
According to ombudsman Mihail Cotorobai, the given legislative proposal is inopportune and the possible consequences are dangerous for the rule of law, democracy, observance of human rights and fundamental freedoms in the Republic of Moldova. The states of emergency can be used as a reason or a pretext for suspending the rights and freedoms guaranteed by the country’s Constitution.
