Acting President Mihai Ghimpu can dissolve the Parliament starting with today, September 21. But the law does not set a time frame within which he should do it, Info-Prim Neo reports. The president of the Constitutional Court Dumitru Pulbere said the circumstances justifying the dissolution of the legislative body appeared on December 7, 2009, when the head of state could not be elected the second time. “The Acting President could issue the decree on June 16, when it was a year of the last dissolution, but the application to this effect was lodged with the Court recently,” he said. Asked what is the period during which Mihai Ghimpu should sign the decree to dissolve Parliament, Dumitru Pulbere said the legislation does not specify this, but the international practice shows this term does not exceed three months. Constitutional Court judge Victor Puscas approved of the judgment, but had a separate opinion. According to him, the invalidated September 5 constitutional referendum was a circumstance over which the Court has not yet taken a decision. Before the deliberations, the Communists Party's representative to the Court Sergiu Sarbu asked the judges to order that Acting President Mihai Ghimpu dissolve the legislature as soon as possible, but the Court rejected his request.
