The lawyer for the owners of the walnut kernel processing and exporting company “VILDVAST-PREST” SRL based in Străşeni district said that owing to abusive actions and chaotic interpretations of the legislation, the clients risk remaining without their business as this is to be transferred under the ownership of a commercial bank. “We want to inform public opinion and the responsible bodies of the created situation. We are facing an information gap and have an unclear reaction from the authorities to the given problem,” lawyer Gheorghe Macovei stated in a news conference at IPN.

The lawyer explained that “VILDVAST-PREST” SRL is under restructuring. “The company raised a number of loans from a bank. In connection with these loans, following repayment difficulties, talks were held and a restructuring procedure plan started to be applied. According to the plan, a number of monthly payments must be made and these continue to be made. The plan is implemented for reaching the final goal. The plan was worked out for a period of three years. As a result, the company is to overcome the financial difficulties and to avoid insolvency. Contrary to the procedure, the bank started to implement the security contract and to auction the collateral,” stated Gheorghe Macovei, noting the company does not have debts to the bank, while the collateral – three apartments - belongs to third parties.

According to the lawyer, last autumn the bank informed the owners that the apartments will be sold. The apartments were groundlessly transferred to the bank by force, through a bailiff. The procedure was challenged in court, but the application was rejected. As a result, the apartments were auctioned last December and the persons remained without their property, but the loans are being repaid according to plan. The property now has other owners and the chances of getting this back are slim.

The limited liability company “VILDVAST-PREST” was founded in 200. It processes, exports and imports walnuts. Veaceslav Rusu, an associate of the company said that for many years he has struggled with the state institutions to prove his innocence in cases started without legal reasons. “All those who fabricated cases weren’t held accountable, even if complaints were filed to the authorities. The company I founded and manage dies gradually. It can no longer cope with the pressure exerted on it daily,” complained the businessman.
