Ombudswoman asks CC to pronounce on allowance for persons with disabilities

The ombudswoman for children’s right Maia Bănărescu requested the Constitutional Court to pronounce on the constitutionality of a phrase from the Law on the Social Inclusion of Persons with Disabilities, which, according to the ombudswoman, is a reason for disadvantaging persons with accentuated disabilities who live in other settlements than the municipality of Chisinau in the provision of the quarterly allowance for transport, IPN reports.

Maia Bănărescu noted the phrase “and the place of residence (districts/municipalities) stipulated in Art. 49 par. (4) of the aforementioned law runs counter to the principle of equity specified in Art.16, in conjuncture with Art.47 and Art. 51 of the Constitution of the Republic of Moldova.

The problem was brought into the ombudswoman’s focus by a person with disabilities who said that the size of the quarterly allowance provided to persons with disabilities varies depending on the place of residence or domicile of these, the persons with disabilities from other localities of the same category than the municipalities of Bălți and Chisinau being disadvantaged.

Currently, the national legislation provides that the persons with accentuated disabilities are entitled to a quarterly allowance in districts of 69 lei, in the municipality of Bălți of 135 lei and in Chisinau of 180 lei.
