Ombudsman’s work could be regulated by Constitution

The Ministry of Justice want the ombudsman’s activity to be regulated by Constitution. The supreme law would stipulate the ombudsman’s mission, immunity, guarantees and other aspects regarding the independence and incompatibilities of this office, IPN reports.

The Constitution would also set the conditions and requirements that must be met by the person applying for this position. Similarly, it would define the ombudsman’s competences and the duty to present annual reports in the Parliament.

According to the Ministry of Justice, this amendment would increase the efficiency and the role of the public advocate and would also improve the level of legal culture among the people by informing them about the existent tools to protect their rights.

The amendment was prepared by taking into account the recommendations of the Venice Commission. The international body suggested the regulation by Constitution of the ombudsman’s activity in order to protect the public advocate’s independence regardless of political changes.
