PAS MP Olesea Stamate said that Marina Tauber should have been fined for the illegalities committed in the courtroom, in accordance with the Contravention Code, and a criminal case shouldn’t have been started against her over interference with the judicial process. This is how Olesea Stamate reacted to the lifting of Marina Tauber’s parliamentary immunity, IPN reports.
On March 14, Parliament voted to lift the immunity of MP Marina Tauber in the case concerning interference with the course of justice. According to acting prosecutor general Ion Munteanu, in April 2023, Tauber tried to disrupt the work of the court. “MP Marina Tauber entered the courtroom and, using a loudspeaker, addressed offensive and threatening messages to the panel of judges and the state prosecutor,” Ion Munteanu explained in the Parliament’s sitting. PAS MP Olesea Stamate said that she refused to participate in lifting the MP’s immunity as Marina Tauber had to be only fined for such actions.
“Undoubtedly, the actions of MP Marina Tauber must be punished, as in the case of any other citizen who violates the law, who disrupts the activity, in particular of the court. But from my point of view, these actions were to be punished administratively, not criminally. There are Contravention Code articles that allow for this. The penalty is quick and effective. The Prosecutor’s Office presented the situation in this case as if the police stopped a citizen with a blood alcohol content of 0.15 and this is evidently an administrative case, but a criminal case is started against this citizen. From my point of view, those actions weren’t criminal in character,” Olesea Stamate stated in the talk show “Resumé” on RliveTV.
She noted that this case will put in a bad light the judges who will give the verdict, whether it will be an acquittal or a conviction one.
“Furthermore, her immunity has been lifted for so many times. Even if we do not enjoy lifting the immunity of the same MP for so many times without seeing an end result, we understand that this is the procedure and each time we voted. But in this case, I decided to stick to my position. What happens if this case goes to court and an acquittal is ordered in this case? The judges who will acquit Marina Tauber in this case will be blamed by society. And what if a conviction is obtained? Others will laugh that she was convicted in such a case. I think things need to be taken a little more seriously,” said the PAS deputy chairman Olesea Stamate.
Since 2019, MP Marina Tauber has had her immunity lifted for nine times, with no end result in any of the nine started cases. According to the law, the immunity of an MP is lifted over each charge.
