Non-execution of Constitutional Court judgments could be penalized

The intentional non-fulfillment by a person with a responsible post of the Constitutional Court judgments and the prevention of their execution could be punished. A relevant legislative initiative to amend and supplement the Penal Code was drafted by MPs of the European People’s Party of Moldova and was registered with the Parliament’s secretariat, IPN reports.

The bill suggests introducing fines of 42,500 to 50,000 lei, 340 hours of community service or up to three years in jail, in all the cases with ban on performing particular activities for a period of two to five years, for such violations.

The party argued that particular state officials with high-ranking posts do not implement the judgments passed by the Constitutional Court and intentionally ignore them. “All the citizens are equal before the law and the non-execution of Constitutional Court judgments should be punished according to the extent of the done damage and the produced effects,” says the informative note to the bill.
