NGO publishes list of persons responsible for Moldova’s conviction by ECHR in 2016

The public association “Jurists for Human Rights” made public a list of persons who are considered to blame for Moldova’s conviction by the European Court of Human Rights (ECHR) in 2016, IPN reports.

The NGO said the move is aimed at contributing to increasing the responsibility of the public authorities and transparency in the decision-making process. The list was compiled based on information provided by lawyers who represented plaintiffs in the ECHR and based on the Court’s judgments. Therefore, the jurists admit that the list can contain inaccuracies.

The “Jurists for Human Rights” noted that according to the information published on the Court’s website, 23 judgments against Moldova were passed in 2016. These cost the state budget over €187,000. In 11 cases, the Court held that the European Convention on Human Rights’ article that bans the use of torture was violated. In other cases, it established that there were violated the rights to liberty and security, to a fair trial or to respect for private and family life and others. In two cases against Moldova, no violation was ascertained, with Russia being blamed in these.

In 2016, the ECHR also published 25 decisions to drop the proceedings. Seven of the cases were withdrawn following amicable settlements reached by the Government of Moldova with plaintiffs, while three after the Court recognized the unilateral statements submitted by the Government. In these ten cases, the Government paid over €49,000 to cover the costs incurred by the plaintiffs, while the Chisinau City Hall €41,000. In the other 15 cases, the invoked violation wasn’t ascertained or the applicant didn’t answer when being contacted by the Court.
