New Urban Planning and Building Code to be presented to Parliament Thursday

The one-story houses in rural areas and the fruit-growing associations could be registered on condition that the owners declare on one’s own responsibility that they respect all the safety norms. This is provided in the Urban Planning and Building Code that was presented by Minister of Infrastructure and Regional Development Andrei Spînu. In a news conference, the minister said that he will go to Parliament on Thursday to present the document, IPN reports.

The Code also envisions the simplification of the procedure for designing urban planning documents in the case of localities with a population of under 3,000. A number of 679 localities will benefit from the simplified procedure. The concept of tacit acceptance of construction works will be annulled as a series of violations were committed in the field based on this, said Andrei Spînu.

Under the Code, the urban development certificate for designing will be optional if the urban design and territorial development documentation is not older than 10 years. In localities in which the urban design documentation is updated, the private individuals will not be obliged to obtain the urban planning certificate. The urban planning certificate and the building or demolition permit for objects declared public utility of national interest will be issued by the institution managed by the central specialized body whose role will be to implement the state policy on urban planning and building.

Andrei Spînu noted that the Sate Register of Urban Planning and Building Companies will be created in Moldova for the first time. The register will be kept by the National Technical Surveillance Inspectorate. In order to facilitate the activity in the field, the list of building works that can be executed without an urban planning certificate for designing and without a building permit was extended. For the first time, a whole chapter is devoted to the state’s and local public administration’s intervention as regards the reduction of the seismic vulnerability of existing buildings and the rehabilitation and modernization of buildings. The Code provides for the rehabilitation and thermic modernization of buildings and relevant installations.

MP Vasile Grădinaru said the new Code prevents the appearance of unauthorized constructions. Emphasis was placed on the ensuring of a normative framework needed to issue permissive documents given that 70-80% of the population does not have approved urban planning documents or the documentation is very old. After the Code is adopted, a Cabinet decision will be approved to stipulate the general urban planning norms.
