New law on delimitation of public property

The Cabinet approved a new draft law on the delimitation of public property in its September 6 meeting, IPN reports.

Even if the current law regulates the delimitation of the public property of the state from the public property of territorial administrative units, this does not stipulate the mechanism by which this should be done. The new law specifies the responsibilities of the authorities in delimiting the public property and registering it.

Under the bill, state public property or public property of the autonomous territorial unit, especially land, cannot be transferred to the share capital of private individuals, cannot be subject to forced collection, cannot be classed as accounts receivable in case of insolvency, cannot be pledged or be considered as real guarantees.

The land owned by the state or the autonomous territorial unit is allotted free to persons in case of natural disasters to build private homes on this or to industrial parks.

The costs associated with the delimiting and registering of public property are to be annually included in the state program for delimiting public property. Other means could be also attracted for the same purpose, like grants from foreign or local donors.
