New amendments proposed to law on prosecution service

A new bill to amend the law on the prosecution service was introduced into Parliament, the head of the legal commission for appointments and immunities Olesea Stamate announced through Facebook. She said the goal of the initiative is to enable persons who gained experience as lawyers, prosecutors or judges at home or abroad to apply for such posts as prosecutor general and chief prosecutors of specialized prosecutor’s offices. The Moldovan citizens who work abroad, but want to help fight crime and corruption in the country will be this way welcomed, IPN reports.

By the same bill, it is proposed constituting a pre-selection commission for choosing candidates for prosecutor general and chief prosecutors of specialized prosecutor’s offices. This will not limit the mandate of the Superior Council of Prosecutors, but will be able to assess the candidates in an appropriate way.

The last amendments to the law on the prosecution service were adopted and promulgated two months ago. These introduced a mechanism for assessing the prosecutor general’s work by creating an assessment commission. The Superior Council of Prosecutors can propose dismissing the prosecutor general to the President if the assessment commission finds the prosecutor general’s work is “unsatisfactory”. The number of members of the Superior Council of Prosecutors was decreased from 15 to 12 by excluding the prosecutor general, the prosecutor of ATU Gagauzia and the president of the Lawyers Union.
