MPs adopt amendments to Family Code in final reading

When being informed about a delivery, the local medical-sanitary institution or family doctor will be obliged to state the child’s birth and to issue a medical birth certificate within three working days, even if the mother does not have the domicile in that settlement. Such provisions are contained in a bill to amend the Labor Code that was passed by Parliament in the final reading, IPN reports.

The conflicts of interests between parents and children will be solved by the local tutelage authority at the place where the child is and its decision can be challenged in court. The interests of the child in this case will be represented by the local tutelage authority.

The parents will bear responsibility for the non-fulfillment or inappropriate fulfillment of the obligations to grow and educate the child. If the placement of the child in a social service was determined by use of violence, negligence, exploitation or abandonment by parents, the court, at the request of the local tutelage authority, will order to collect from parent/parents the costs associated with the bringing up and education of the child in the social service since placement until integration into the family.

If the parents intentionally avoid fulfilling their parental obligations and this determines the child’s placement, these will be fined 15,000 or 25,000 lei or will do 100 to 120 hours of community service. If these intentionally avoid (re)integrating the child into the family, they will be fined 15,000 to 40,000 lei or will do 120 to 150 hours of community service.
