Moldova risk being convicted by ECHR for legal system abuses, lawyer

Lawyer Cristina Doga, who defends the former partner of Guzun family, the founder of the Lyceum “Da Vinci”, said the Republic of Moldova risks being convicted by the European Cotuit of Human Rights for the violations committed by the legal system against her client. In a news conference at IPN, Cristina Doga said that this is an unprecedented case in the legal system and the prosecution system, which involves Adrian Balan, the ex-partner of Guzun family. The lawyer noted the filed complaints contain evidence of tax evasion, false statements, persuasion to make false statements and if these are not examined as the law provides, this case will evidently reach the ECHR.

“At the ECHR, the Republic of Moldova will be convicted for these illegalities committed by the Prosecutor’s Office and courts of law, in cooperation with Guzun family trough the agency of clients of the school. I think the state is now not ready to assume responsibility and pay damages to Balan Adrian based on ECHR judgments. Measures should be therefore taken at the national level and an institution should examine this case,” said the lawyer.

Adrian Balan said the education institution is used by the former partners as an instrument of intimidation through the agency of the legal system and of camouflaging of criminal schemes. He invoked evidently illegal court decisions, the complicity of the law enforcement agencies and threats with use of violence and liquidation.

The former partner accuses the couple of gross illegalities and accuses the corrupt representatives of the law enforcement agencies of facilitating interference in their work at a time that they should defend the rule of law. “In fact, things are plain. There is a situation that is normally solved by a five-minute discussion between people who built from zero and without money what today is known as “Da Vinci”, or by a ten-minute court hearing, on condition that this is chaired by an honest judge,” stated Adrian Balan.

He noted that when the contract for the public private partnership with the Chisinau City Hall was signed, Efrosinia Guzun decided that they no longer needed him and he should remove him from the business. After a wave of scandals and intimidations against him, he decided to withdraw from the project on condition that he is paid for the four years and a half he worked hand in hand with the two. He told them that they can decide the sum themselves, but more dirt and disputes followed, including a criminal case against him.
