Moldova obliged by ECHR to pay over €350,000 damages in 2023

Moldova in 2023 was obliged to pay over €350,000 damages for nonobservance of human rights. From 1997 to 2023, the damages totaled €22.8 million.

In a press conference hosted by IPN, Vladislav Gribincea, director of the Justice Program of the Legal Resources Center from Moldova (LRCM), said that in 2023 the European Court of Human Rights (ECHR) passed 24 judgments on cases involving Moldova. The number of judgements passed in 2023 is the lowest one in the last five years, being comparable to the number of judgements pronounced in 2014-2018. The Court passed fewer, but more complex judgments. The 24 judgments referred to 32 violations of the European Convention on Human Rights.

Fourteen violations out of 32, which is almost half, refer to how cases are examined in court or how court decisions are enforced. Six violations refer to the right to privacy. It often goes to relationships between parents and children. Five violations relate to liberty and security, mainly the way judges examine arrest warrants.

In 11 cases, the Government entered into amicable settlement agreements with plaintiffs, or plaintiffs did not agree to enter into an amicable settlement agreement when the Government made a reasonable proposal.

According to Vladislav Gribincea, from a legal viewpoint, among the most important cases examined in 2023 were the cases of Stoianoglo, Manole, Filat and Iordăchescu. “All these cases refer to the way judges fulfilled their duties,” said the director of LRCM’s Justice Program.

At the end of last year, there were 1,149 applications against Moldova pending examination at the ECHR. Out of these, 97% have high chances of being successful and this figure is higher than the total number of Moldova’s convictions over the last 26 years, said Daniel Goinic, director of the Human Rights Program of LRCM.

By December 31, 2023, the Court passed a total of 599 judgments in Moldovan cases, in which it found 786 human rights violations.
