Mihai Ghimpu: Mayor cannot be removed before time by referendum

Dorin Chirtoaca cannot be removed from the post of mayor general of Chisinau before time by referendum, the Liberal Party’s chairman Mihai Ghimpu stated in the talk show “Important” on TVC21 channel, IPN reports.

According to the Liberal leader, there are disparities between the Electoral Code and the Law on Local Public Administration. The chapter on the work of the mayor does not stipulate the possibility of dismissing this before time by referendum. “We will analyze this aspect and could go to the Constitutional Court. The mayor cannot be removed by referendum before time,” stated Mihai Ghimpu.

He also said the Electoral Code specifies that the mayor can be discharged by referendum if this does not respect the interests of the community, does not property fulfill the duties stipulated by law, violates the moral and ethical norms and the deeds are confirmed in the specified way. Such violations were to be stated by an institution or a court of law. “What did the mayor violate? This is what the judge who examined the Socialists’ application to register the signatures collected in favor of the referendum should have started from,” noted the Liberal leader.

Mihai Ghimpu stated that the criminal cases started against the mayor of Chisinau municipality are a political order.

On September 12, the Chisinau Municipal Council set the date of the local referendum on the dismissal of Dorin Chirtoaca from the post of mayor general of Chisinau. The inhabitants of Chisinau and its suburbs are expected to cast their votes in the plebiscite on November 19. The decision was taken by the votes of 26 councilors of the total of 51. Dorin Chirtoaca is the first deputy chairman of the Liberal Party. He is investigated for passive corruption and influence peddling. He pleads not guilty.  

The collection of signatures for the referendum on the dismissal of Dorin Chirtoaca was initiated by the Party of Socialists of the Republic of Moldova.
