Mediation to be applied in fiscal litigations too

The draft law on fiscal mediation has been returned to relevant public authorities and non-governmental organizations for reconsideration, said Tatiana Loghin, the head of the Main Fiscal Inspectorate. She has mentioned that the fiscal mediation is a tool of solving litigations of fiscal kind, in an efficient manner, trough other procedures than the court ones. “Unfortunately the fiscal mediation did not assert itself in Moldova and any fiscal litigation is solved in courts. And this implies wasting times and money,” Tatiana Loghin said. According to the draft, the procedure of fiscal mediation is confidential. The mediators will be chosen by both litigating sides, by one by each party. Anyway, the parties can go to court any time, if they cannot reach an agreement. Tatiana Loghin has specified that the US Project on Good Governance is providing a lot of assistance in drafting the law as part of the “Millennium Challenge Program” and through the agency of the Arbitrage and Mediation Court. Developing the draft law on fiscal mediation is due to end by December 2008. Till then, also the fiscal mediation institution is to be instituted.
