Mediation as an alternative to settling disputes

The Cabinet approved a bill providing that the sides involved in a conflict will be able to use the services of a state-paid mediator to resolve the dispute, IPN reports.

Mediation is a form of settling conflicts between two and more sides with the assistance of a third person called a mediator. In order to motivate the sides taking part in an argument to choose mediation, there will be set such concessions as exemption, rescheduling or total or partial refunding of the state tax. The sides will be also able to benefit from the service of a mediator paid by the state.

The sides who will take part in mediation, but it will end without reaching an agreement, will be exempted from paying 25% of the state tax when filing a lawsuit.

Minister of Justice Oleg Efrim said the new law was drafted in accordance with the report on the monitoring of the implementation of the Law on Mediation, which revealed a number of legislative deficiencies, especially as regards the regulation of the mediation process, the status of mediator and the method of organizing the mediator’s work. The bill is to be discussed and passed in Parliament.
