The procedure for selecting candidates for the post of judge and the procedure for appointing them are disagreeing and the mechanism should be thus changed, consider authors of a relevant study, IPN reports.
In the program “Place for dialogue” on the public station Radio Moldova, study co-author Vlad Gribincea, director of the Legal Resources Center, said that though clear criteria are set for selecting the judges, the Supreme Council of Magistrate, which appoints them to post, often ignores these criteria.
“The candidates for the post of judge are chosen according to particular criteria by a special board. But, when the candidates are examined by the Supreme Council of Magistrates, these criteria are no longer taken into account. The candidates who meet all the criteria are often rejected and persons who do not meet these criteria are named instead of them. We thus underline the necessity of changing this mechanism so as to prevent such a situation,” stated Vlad Cribincea.
He also spoke about the procedure for confiscating the property of judges suspected of obtaining it illegally. “The proposed mechanism is so complicated that I doubt it will be functional,” he said.
Another author of the study Teodor Carnat, who is a member of the Supreme Council of Magistrates, said the institution selecting and promoting judges should be strengthened. “The board is obliged to communicate the criteria that the candidates for judge met, but the members of the Supreme Council of Magistrates vote for the fielded candidates without providing explanations. This fact affects the image of the Supreme Council of Magistrates. The people want competent judges and expect the Council to name such judges,” he stated.
